The loss had to have resulted from some sort of negligence that can be proved in court on the part of the landlord. Your landlord would have to be given a reasonable opportunity to remedy the situation first. You also have a breach of the warranty of habitability on the part of the landlord. That would be grounds to recover your rent since the apartment was not habitable due to the bedbugs.
